PURCHASING INFORMATION

ORDERING

1. Select the products you wish to purchase from the e-shop and click the “Add to cart” button.
2. By opening the shopping cart, you have the opportunity to adjust the quantity of products and delete items from the cart. If you have a discount code, it can also be entered here.
3. Once you have added all products to the shopping cart, click the “Checkout” button.
4. All fields marked with an asterisk (*) must be completed in the order form.
5. Select the appropriate shipping method on the checkout page. It is also important to enter the delivery address for the goods.
6. Then select a suitable payment method, agree to the e-shop terms and conditions, and click the “Place order” button.

PRICES AND PAYMENT

All our prices (in the e-shop) are in euros.

After placing the order, it is possible to pay for the order using either a bank link or a bank transfer. The invoice will be sent to your email after the order has been completed.

DELIVERY TIME AND TRANSPORT

We deliver the goods to your requested address across Estonia within 3 working days at the latest after the prepayment invoice has been received. The exact time of delivery will be agreed upon in advance via telephone or email. Goods are delivered on working days between 10:00 AM and 5:00 PM.

RETURNING GOODS

The return of goods takes place in accordance with the laws in force in the Republic of Estonia. Detailed information can be found in the General and Purchase Terms.

PRIVACY

Shopping in our e-shop is secure; your personal data will not be disclosed to third parties and will only be used to fulfill the order and resolve order-related issues.

GENERAL AND PURCHASE TERMS, AGREEMENT AND LIABILITY

These Terms constitute a binding agreement for the delivery of goods via this website between you, as the person ordering products offered on the Hortulus OÜ website, and Hortulus OÜ, Harju County, Tallinn, Kesklinna district, Pärnu maantee 368, 11612, hereinafter referred to as Hortulus OÜ. By using this website, you agree to these Terms, which also apply to all orders placed through or in connection with this website.

Offers made by Hortulus OÜ and descriptions of products and services are not to be considered a contract and are not subject to these Terms. Product images are for illustrative purposes only.

DELIVERY OF PRODUCTS IN ESTONIA

All products ordered by you will be sent to the destination you specified when placing the order, using the delivery method you selected.

The delivery price calculation is performed automatically, and its final price is shown separately on the invoice.

The seller delivers the goods to the specified address across Estonia within 3 working days at the latest after the prepayment invoice has been received.

Hortulus OÜ is not responsible for the delivery of goods if the address you provided when placing the order is incorrect.

Hortulus OÜ may, at its sole discretion, refuse your orders without any explanation.

PRICE INFORMATION

Prices in the e-shop include VAT.

Postage costs are indicated separately.

The currency of the e-shop is the euro.

Goods sold in the e-shop can be paid for by bank transfer based on an invoice.

The online store is not responsible for any other taxes or customs duties that may be applied to you, for which full responsibility remains with you.

The online store reserves the full right to change the price list at its discretion and without prior notice in all cases, except for those where an order has been confirmed but not yet fulfilled.

The purchase price is paid as a prepayment via bank link or bank transfer.

Hortulus OÜ is the controller of personal data.

When making purchases from the e-shop, it is also possible to use coupon codes, which can be entered at checkout. Coupon codes are shared in online store advertisements and marketing channels.

RIGHT OF WITHDRAWAL

1. The customer has the right to withdraw from the contract (return the products) within 14 calendar days of receiving the products, except in the cases specified in points 2 and 3.
2. Pursuant to § 53(2)(9) of the Law of Obligations Act (hereinafter: LOA), the 14-day right of withdrawal does not apply to the purchase of foodstuffs, beverages, and/or other goods intended for everyday consumption, which are delivered during frequent and regular rounds by the trader to the consumer’s home, residence, or workplace.
3. Pursuant to the points of § 53(4) of the LOA, the 14-day right of withdrawal does not apply, inter alia, to: – products that deteriorate or expire rapidly; – the delivery of products in sealed packaging which are not suitable for return for health protection or hygiene reasons and if they have been opened after delivery; – products for which specific or recommended storage conditions are prescribed.
4. To withdraw from the contract, the Customer must submit a Return Application. The Customer can submit the Return Application by sending it to the Seller’s email address: hortulus@hortulus.ee or by sending an email from the Seller’s website. After the application has been reviewed by the Seller, the customer will be notified of the return address.
5. Returned products must not be spoiled, damaged, or used, and must be in their original product packaging. To establish the nature, characteristics, and functioning of the goods, the Customer should handle the product only as they would normally be allowed to do in a shop. The product packaging must be opened carefully without damaging it. Otherwise, the Seller has the right to demand compensation from the Customer for the decrease in the value of the product.
6. Returned products must be sent to the Seller immediately, but no later than 14 days after submitting the withdrawal application. The costs associated with returning the product shall be borne by the Customer.
7. If the Customer has withdrawn from the contract, returned the products to the Seller, and the returned products are in proper condition (including considering the provisions in points 2 and 3), the Seller shall refund the cost of the order along with the delivery fee to the Customer within 14 days of submitting the withdrawal application. Refunds will be made to the same bank account from which the payment for the order was received.
8. If, after the return of the goods, it appears that the return does not meet the conditions set out in the User Agreement, the money will not be refunded.

If the goods are broken or have significant damage that was not immediately identifiable upon external inspection and did not occur when opening the package, or if the goods are incorrect, please notify Hortulus OÜ immediately at hortulus@hortulus.ee.

PROCEDURE FOR SUBMITTING CLAIMS

The online store is responsible for any non-compliance or defect of the goods sold to the buyer that existed at the time of delivery and which appears within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the item to the buyer, it is presumed that the defect existed at the time of delivery.

In the event of a defect, the buyer has the right to contact the online store within two months at the latest by sending an email to hortulus@hortulus.ee.

The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.

If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the online store will refund all fees associated with the sales contract to the buyer.

The online store will respond to the complaint submitted by the consumer in writing or in a format that can be reproduced in writing within 15 days.

SECURITY

The online store uses all reasonable means to prevent any security-related violations of the law, including the credit card information provided by you. The online store also uses all reasonable means to ensure that every supplier/subcontractor or partner of the online store also ensures the confidentiality of the data at their disposal. You are solely responsible for the security and use of your usernames and passwords required to access the service or any part thereof. Any use of your password will be interpreted as being entered by you, and you are responsible for all activities performed under that password.

AVAILABILITY OF GOODS

Hortulus OÜ reserves the right to suspend, change, or replace the list of goods for sale in the web environment without notice and without any reason.

OTHER TERMS

Nothing in these Terms gives any third party any benefit or right to enforce the terms of this Agreement. These Terms constitute the entire agreement between you and the online store and supersede any oral or written agreements or other statements. The online store reserves the right, at its discretion and at any time, to add to or change these Terms without prior notice (this does not apply to confirmed orders that are yet to be fulfilled). These Terms are subject to the laws of the Republic of Estonia and are within the jurisdiction of the court system of the Republic of Estonia. You must ensure that you have read and fully understood these Terms before placing an order.
